- The object of these general terms is the purchase of products
and services, realized online through the website "hardstore.com"
belonging to RSM TRADE srl whose head office is in Falciano
- Republic of San Marino, Strada degli Angariari 25/19.
- Each operation of purchase will be subject to the laws in force
in the Republic of San Marino. As far as concerns the tutelage
of privacy it will be subject to the Law n. 675/96 and its following
changes.
After receiving the confirmation of the purchase
order, the Customer unconditionally agrees and undertakes to respect,
in the relationship with RSM TRADE srl also known as hardstore.com,
the general terms and the payment terms as hereinafter defined,
declaring to have a full understanding and acceptance of all the
indications provided above, also noting that hardscore.com is not
bound to different conditions unless preventively agreed in written
form.

- The Customers who visit the website hardstore.com must look
into these General Sales Terms, before confirming their purchases.
Thus, the forwarding of the order confirmation implicates the
total knowledge of these General Sales Terms and the full acceptance
of such conditions.
- After concluding the procedure of online purchase, the customer
undertakes to print and preserve the general sales terms set forth
herein, already analysed and accepted during the purchase process.
The customer must pay the products and the respective forwarding charges
when he receives the order confirmation, by using one of the credit
cards shown online, or directly paying the carrier/postman in the
case that the customer choses to pay cash on delivery.
- Credit card payment
For those who use credit card, www.hardstore.com has chosen BANCA
STELLA electronic payment system. To make it sure, the payment
is made directly on the safe server of the bank. As far as concerns
“booked/pre-order” products, hardstore.com reserves the right
of gaining credit on the whole order within 5 days after the order
date, even though the praxis is to credit the ammount when the
goods are ready to be executed. Unfortunately, in order to avoid
fraudulent uses of credit cards on our website, for the first
transaction we are obliged to ask for a copy of the CREDIT CARD,
both on front and back side, and of an identity document to be
sent by fax. These data will be kept on one of our protected files.
- PayPal payment - On the European Community territory

- Cash Payment on delivery COD – On the European Community
territory
The cash payment is subject to the following conditions:
- The payment is only possible through UPS carrier and is
only accepted for ammount inferior to 1500 EUR. If the ammount
is superior, the customer will be asked for payment in advance
- The carrier only accepts exact ammount, corresponding to
the order amount (change is not provided)
- The orders with cash payment will be executed only at the
time of the complete availability of the goods (i.e: if the
order includes booked Videogames, it will be forwarded after
their coming out). However, the order can be partially executed
by calling our staff.
- To manage this kind of payment at
European level the customer will be charged with a 10 EUR
fixed commission and a 1% on the goods value. These expenses
will be added to the forwarding charges.

- Hardscore.com will deliver the products bought at the address
the Customer has indicated, all throughout Europe. However it
is necessary to point out if the purchase has been made as Private
Citizen or as Company.
PRIVATE CITIZEN
Each forwarding presents the following characteristics:
- there is the issue of a FISCAL RECEIPT with the debit of
the prices, including taxes of 17% (thus the purchase with
INCLUDED TAXES is valid both for Italian and Europen customers)
- The goods are not subject to customs operations and
are sent as community package. All this allows notable advantages
in terms of costs and speed
- Cash payment is allowed ALL THROUGHOUT EUROPE!
SOCIETY DOMICILED IN A COMMUNITY COUNTRY
(different from ITALY)
Each forwarding presents the following characteristics:
- There is the issue of an INVOICE without the debit of VAT.
The customer will only pay the cost of the goods
- THE GOODS WILL BE SUBJECT TO CUSTOMS OPERATIONS and will
be managed by carriers as EXTRA COMMUNITY DELIVERY (with debit
of IVA and possible taxes). The average times of transit will
consist of one day more than the normal transit time of the
carrier chosen
- Cash payment is allowed ALL THROUGHOUT EUROPE!
- The goods can be sent through RECEIPT which will not be
valid from a fiscal viewpoint in the country of destination.
In this case, the goods will be subject to an increase of
17% San Marino taxes, but they will be deprived of VAT or
the Customs duty of the country of destination.
The most frequent form applied to Companies is “VAT EXEMPTION
with BILLING and CUSTOMS OPERATIONS”. If the Customer prefers,
we can modify the registry as “TAXES INCLUDED WITHOUT CUSTOMS
OPERATIONS”.
- The products will be delivered during working days. Hardstore.com
delivery can be divided, but hardstore.com is deprived of any
responsability.
- For deliveries all throughout European territory hardstore.com
makes use of:
FED.EX (for forwardings subject to customs operations) - UPS (for
forwardings deprived of customs operations)
Normally, the carriers used do not make preventive calls nor manage
requests in particualr times. Without any involvement of hardstore.com
and depending on the availability of the products besides other indipendent
causes, hardstore.com will indicatively deliver the goods to the carrier
within 48 hours from the first working-day following the date of the
receipt of the order ( in the case of payment through credit card
or cash payment)
The orders will be only executed when the goods will be completely
available. If the customer wants to receive the goods available
immediately and postpone the delivery of the products which are
not available or booked, the customer will have to chose the double
forwarding, by indicating it in the order notes with consequent
debit of the double forwarding. In the case that the promotion ‘Free
Transport’ is active, the second forwarding will be charged to the
customer.
Delivery times and their respective costs depend on the forwarding
conditions and on the carrier choses:
- UPS Carrier (only for delivery deprived of customs operations
to private or firms): from 1 to 3 working-days (for more detailed
information visit the website www.ups.com)
- FED:EX Carrier (only for EU and EXTRA EU deliveries with customs
operations): from 1 to 2 working days
The service of cash payment involves an additional cost which is different
according to the carrier chosen. Currently, only UPS allows this kind
of service at European level During the promotions “Free Transport”
hardstore.com reserves the right of chosing the forwarding conditions.The
customer must verify if the package is complete, not damaged nor wet.Only
after such check, the customer can accept the delivery. After accepting
the delivery, the customer will not have any possibility of contesting
the external characteristics of the goods received. In the case there
is no correspondance between the order and the goods delivered, the
customer will not have to accept the goods and will have to raise
an objection directly against the carrier besides writing an e-mail

has indicated, almost all over the world. Not all the countries
are reached by our carriers and our website. If you live in one
of the countries that do not appear during the registration, we

PRIVATE CITIZEN
Each forwarding presents the following characteristics:
- VThere is an invoice without debit of taxes or VAT
- GOODS ARE SUBJECT TO CUSTOMS OPERATIONS. We invite you to
control in the customs offices of your country the TAXES or
DUTIES necessary for goods coming from THE REPUBLIC OF SAN MARINO.
- The payment can only be anticipated.
- The products will be delivered during working days. Hardstore.com
delivery can be divided, but hardstore.com is deprived of any
responsability.
- For deliveries in all the EXTRA UE (Europe) COUNTRIES hardstore.com
makes use of: FED.EX (for forwardings subject to customs operations)

the right of chosing the forwarding conditions.
The customer must verify if the package is complete, not damaged nor
wet.
Only after such check, the customer can accept the delivery. After
accepting the delivery, the customer will not have any possibility
of contesting the external characteristics of the goods received.
In the case there is no correspondance between the order and the goods
delivered, the customer will not have to accept the goods and will

- The products bought through hardstore.com are subject to the
commercial discipline of San Marino. This warranty will be applied
to the product which will present defects or malfunctions not
verifiable at the time of the purchase, provided that the product
is correctly used , that is to say respecting its right utilization
according to what is pointed out in the technical documentation
and following the various operational norms indicated hereunder.
- On the contrary, the above warranty will not be applicable in
case of negligence, carelessness in the use and in the maintenance
of the product, or in the use of the product with electrical systems
or any other kind of connection that is not according to law.
The warranty is personal and will only apply to the original buyer,
being it reserved to direct customers and not to dealers, retailers
etc.
- The eventual malfunction of the products must be pointed out
in written form by the customer within the legal term at the time
of the second forwarding. The second forwarding must preventively
be agreed with the customer care. In this page you will find the

- harstore.com reserves the possibility of verifying the real
presence of defects denounced by the customer and replacing the
product only after such control.
- The demand will be executed only if in the package come back
there will be the following documents: receipt or invoice, RMA
number to authorize the return of defective goods to be realeased
by our staff (such a number must be written outside the package
in a very visible way)
- On the contrary, the return expenses will be charged to the
customer. In specifical cases, such as FORWARDING ERRORS or NOT
CONFORMING GOODS we can agree to pay the expenses. However the
expenses will be charged to the customer if RMA is asked later
than 7 days after receiving the package.
- According to the discipline of correspondence commerce of the
Republic of San Marino, the customer can practice the recess right,
within 7 working days from the receipt of the goods
- Such right is applicable to all the products of the website
hardstore.com, excluding the audiovisual products or computer/videogame
software delivered sealed and successively opened by the customer
- According to the discipline of correspondence commerce of the
Republic of San Marino, we point out that the recess right is
exclusively reserved to those customers who can be defined “consumers”
that is to say only to those physical people who buy the products
for their personal use and act with purposes which are not linked
to their professional activity, thus with the exclusion of dealers,
retailers, professional men etc.
Conditions to practice the recess right
- To practice the recess right, the customer must send, within
the term set forth in art. 8 of these General Sales Terms, a registered
letter with advice of receipt, or a telefax, telegram or telex,
confirmed through registered letter within the following 48 hours,
to the following address:

- hardstore.com will transmit the accredit concerning the goods
cost and the first forwarding charges within fourteen working
days from the date in which the customer has sent the goods and,
in any case, not before the receipt of the products
- Such operation will be made through the Credit Institute of
the card used or by accrediting the A/C indicated by the Customer
- The return expenses are instead charged to the Customer
- hardstore.com will reject any product returned without wrapping
or packaged in conditions different from the ones pointed out
above. The same treatment will concern all the products for which
the customer has not totally paid the return charges yet.
- hardstore.com will reject any product for which the customer
has not totally paid the return charges yet. Hardstore. com will
react in the same way also if the customer does not respect the
conditions and the times provided by Law as far as concerns the
recess right, or in the case the product is not packaged with
its original wrapping or it is delivered deprived of any accessory,
any handbook and anything concerning the product in its origins.

The personal data you have given and you will give us are used to
execute the trading contract you are a party of, as well as to carry
out the consequent obbligations imposed by laws, rules or community
normative. Your personal data will be used for promotional and advertising

to other societies. We have adopted the right measures for the use
of your personal data. We undertake to conform such measures to what
will be established by future legislative modifications, as well as
